Welcome to Rameshwaram Marble. These Terms and Conditions (“Terms”) govern your access to and use of our website, services, and the purchase of our natural marble handicrafts, custom sculptures, architectural stone elements, and inlay artwork.

By browsing our website, placing an order, or requesting a quotation, you agree to be bound by these Terms. Please read them carefully.

1. General Overview & Business Information

These Terms constitute a legally binding agreement between you (“Client,” “Customer,” or “User”) and Rameshwaram Marble (“Company,” “we,” “us,” or “our”).

2. Natural Stone Characteristics & Hand-Carved Disclaimer

Marble, granite, sandstone, and natural gems are organic materials created by nature. By purchasing from Rameshwaram Marble, you acknowledge and agree to the following inherent characteristics of natural stone:

  • Natural Variations: Color, veining, texture, tone, and structural grain vary from block to block. Photos on our website or catalogs serve as general representations. No two natural stone pieces are identical.
  • Handcrafted Tolerances: Because our products are hand-carved by skilled artisans, minor dimensional variances (typically ±2% to 5%), carving nuances, and hand-finishing differences are normal and expected.
  • Fissures & Pitting: Natural stone may feature minor surface pitting, micro-vein lines, or geological fissures filled during processing. These are natural characteristics, not manufacturing defects.

3. Custom Orders & Design Approvals

For bespoke sculptures, custom architectural columns, temples, or tailored stone inlay projects:

  1. Design Approval: We may provide 2D drawings, 3D renderings, or stone sample photos prior to carving. Production commences only after explicit client approval of designs and specifications.
  2. Work-in-Progress (WIP) Photos: For custom statues and complex carvings, we share WIP photos/videos during carving. Modifications requested after carving phase milestones may incur additional material or labor fees.
  3. Final Approval: Once the final piece is completed, photos/videos will be provided for your final dispatch approval.

4. Pricing, Quotations & Payment Terms

  • Currency & Quotes: Prices are quoted in Indian Rupees (INR) for domestic orders or USD/EUR for international export orders. Official written quotes are valid for 30 days unless specified otherwise due to raw material price fluctuations.
  • Payment Terms for Custom Items:
    • Advance Deposit: A non-refundable deposit of 50% is required to begin custom carving and stone selection.
    • Balance Payment: The remaining 50% balance is due upon final carving approval prior to wooden crating and dispatch.
  • Payment Methods: Payments can be made via direct Bank Wire Transfer (NEFT/RTGS/SWIFT), UPI, or approved Payment Gateway links.
  • Taxes & Customs: Domestic orders attract applicable Goods and Services Tax (GST). International orders are exported under standard export documentation; recipient customs duties, import tariffs, or local port handling fees in the destination country are the sole responsibility of the buyer.

5. Shipping, Packaging & Freight Delivery

  • Wooden Crating: To ensure maximum safety during transit, heavy marble products and delicate sculptures are packed in export-grade, fumigated, wooden crates with shock-absorbing foam lining.
  • Delivery Scope:
    • Curbside / Port Delivery: Unless explicitly contracted for white-glove installation, freight and courier shipments are curbside delivery or port-to-port.
    • Offloading Responsibility: Unloading heavy stone crates from the transport vehicle requires appropriate equipment (e.g., forklifts, cranes, or manual labor), which is the responsibility of the client/consignee at the delivery site.
  • Transit Risk & Insurance: All long-distance shipments are covered under transit insurance up to the delivery site or port, subject to insurer terms.

6. Receiving Shipments & Inspection Policy

CRITICAL: Stone shipments must be inspected upon arrival.

  1. Inspect Before Signing: Prior to signing the carrier’s Proof of Delivery (POD) receipt, carefully inspect the outer wooden crating for visible signs of damage, drop impact, or breakage.
  2. Noting Damage: If any damage is observed, you MUST write “Crate Damaged / Subject to Internal Inspection” on the carrier’s delivery receipt and photograph the unopened damaged crate.
  3. Notification Window: Any internal breakage or transit damage must be reported to Rameshwaram Marble within 48 hours of receipt with clear unboxing photographs/videos and a copy of the carrier receipt.

7. Cancellation, Returns & Refund Policy

  • Ready-Stock Items: Standard ready-stock items may be returned or exchanged within 7 days of delivery, provided they are unused, undamaged, and returned in original packaging. The buyer covers all return freight charges.
  • Custom & Made-to-Order Items: Custom carvings, customized sizes, personalized inlay work, and client-approved sculptures are non-refundable and non-returnable once production has commenced.
  • Damaged Items: If an item arrives damaged due to transit and proper damage notification protocols (Clause 6) were followed, Rameshwaram Marble will repair, replace, or process an insurance claim for the damaged component at no additional cost to the client.

8. Intellectual Property Rights

All content published on our website and marketing materials—including product designs, stone carving patterns, photography, logos, branding, and text—is the exclusive intellectual property of Rameshwaram Marble. Unauthorized copying, reproduction, or commercial distribution of our designs without express written consent is strictly prohibited.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Rameshwaram Marble shall not be liable for any indirect, incidental, punitive, or consequential damages arising from the use of our products or website.
  • Our total liability for any claim related to an order shall not exceed the total amount paid by the customer for that specific order.
  • We are not liable for structural damage, injuries, or installation failures resulting from improper handling, unapproved mounting techniques, or third-party contractor errors at the client’s site.

10. Force Majeure

Rameshwaram Marble shall not be held liable for failure or delay in fulfilling performance obligations if such failure arises from causes beyond our reasonable control, including but not limited to natural disasters, quarrying disruptions, severe weather, freight/port strikes, government export restrictions, or global supply chain blockades.

11. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to your transactions with Rameshwaram Marble shall be governed by and construed in accordance with the laws of India.

Any legal proceedings, disputes, or claims shall be subject to the exclusive jurisdiction of the competent courts located in Udaipur, Rajasthan, India.
